Farida Dankaka’s nomination refreshes storm over abuse of federal character principle

The nomination of Dr. Farida Muheeba Dankaka as chairman of the Federal Character Commission (FCC) by President Muhammadu Buhari has refreshed the controversy over the president’s perceived non-application of the principle of federal character in his key appointments.

The President of the Senate, Dr. Ahmad Lawan, had on Tuesday read the president’s letter seeking Senate approval for the nomination of Dankaka and 37 others as chairman and members of the commission, instituted by Section 14(3) of the 1999 Constitution as amended, to ensure that no section of the country dominates appointments to the federal government and its agencies.

Specifically, the section specifies: “The composition of the Government of the Federation or any of its agencies and the conduct of its affairs shall be carried out in such a manner as to reflect the federal character of Nigeria and the need to promote national unity, and also to command national loyalty, thereby ensuring that there shall be no predominance of persons from a few states or from a few ethnic or other sectional groups in that government or in any of its agencies.”
FCC is saddled with the responsibility of enforcing this constitutional provision.

Dankaka’s nomination is said to be in conflict with this provision of the constitution on the ground that she is from Kwara State, Northern Nigeria, she ought not to have been so nominated because the secretary of the commission, Mr. Muhammad Tukur, is from Taraba State also from the North.

The critics’ argument is that this pattern of appointment negates the constitution, the enabling law and convention.

They refer to Section 4 of the enabling law, Federal Character Commission Act No 34 of 1996, to buttress their argument. It states: “Where the number of positions available cannot go round, the states of the federation or the Federal Capital, the distribution shall be on a zonal basis. But in the case where two positions are available, the positions shall be shared between the northern and southern zones.”

For them, the two principal positions are the chairman and secretary of the commission and by the spirit and letters of the law, they ought to be distributed between the North and the South.

They also summon convention as their witness, saying past administrations have maintained a balance in appointments between the two principal geo-political zones.

According to them, a brief history of the leadership of the commission shows that from 1996 till date, there have been lopsided appointments of the executive chairmen of the commission.

For instance, Alhaji Adamu Fika from Yobe in North-east; Alhaji Bello Kofabai from Katsina in the North-west and Professor Shuaibu Oba Abdul Raheem from Kwara in the North-central, have held the position since 1996.

In acting capacity, the chairmanship of the commission has been held by Alhaji Muhammadu Ari-Gwaska from North-central; Alhaji Ibrahim Funtua, from Katsina in the North-west; Alhaji Muhammad Alkali from Kebbi in North-west; Dr. Shettima Bukar Abba from Borno in the North-east; Mr. Abayomi Sheba from Ondo in the South-west, and Ambassador Shinkafi from Zamfara State, the current acting chairman whose tenure ended on April 20, 2020, after two terms in office is from the North-west. West.

It was gathered that during the period under review, the position of the substantive secretary was held by southerners, including Mr. A. O. Effenga from South-south; Mr. O. P Emerhan from South-south; Prof. Francis Durosinmi-Etti from South-west; and Mr. Rex-Ogbuku from South-south.

In acting capacity, Mr. David O. Fakeye from South-west and Mr. Jonas C. Umeh from South-east have also held the position.
The incumbent secretary is Tukur, who was appointed by Buhari in March 2017 for an initial tenure of four years, which would end in February 2021, is from Taraba State in the North-east.

Newsmen gathered that according to the principle of federal character, as contained in the Act governing the commission, leadership positions ought to be equally distributed between zones.

The implication, it was learnt, would be that the chairmanship position should, going by the principle of federal character and as stated in the constitution, automatically, go to the southern part of the country.

This North-South balance had been established by the presidency of Chief Olusegun Obasanjo, Alhaji Umaru Yar’Adua and Dr. Goodluck Jonathan who had appointed northerners as chairmen and southerners as secretaries.

“When Mr. President appointed Mohammed Bello Tukur, the Legal Adviser of the Miyetti Allah Cattle Breeders Association of Nigeria (MACBAN) as the secretary of the Federal Character Commission, many thought it was to pave the way for the first Southern chairman of the commission. That was not to be,” said a displeased senator who preferred anonymity, adding: “Instead in a rather brazen act, the penultimate Ag. Chairman, Mallam Shettima, rather than handover to a southern commissioner handed over to the secretary of the commission.”

The senator, who urged his colleagues not to confirm the nomination of the chairman of the commission, accused the Buhari administration of consistently violating “one of the most ingenious and ambitious affirmative actions entrenched in our constitution to promote national unity uniquely named federal character.”

“This consistent negation of a critical national consensus should be resisted and rejected by all well-meaning Nigerians starting from the Senate. The seeds of national discord have been systematically sowed over the past five years and should be halted,” he alleged.

The senator urged the Senate to defend the supremacy of the constitution and the need to build an inclusive state.
Buhari, in a letter dated 18th March 2020 to the President of the Senate, nominated Dankaka, a businesswoman, who was also a former president of Kaduna Chamber of Commerce, Industry, Mines and Agriculture (KADCCIMA), as the chairperson of FCC and 37 others as members of the board.

The 37 members are Henry Ogbulogo, Salihu Bello, Obonganwan Ebong, Ibeabuchi Uche, Mohammed Tijjani, Tonye Okio, Silas Macikpah, Abba Monguno and Nsor Atamgba.

Others are Alims Agoda, Tobias Chukwuemeka (deceased), Imuetinyan Festus, Sesan Fatoba, Ginika Florence Tor, Hamza Mohammed, Diogu Uche, Lawan Roni and Hadiza Muazu.

Also appointed are Muhammad Na‘iya, Lawal Garba, Abubakar Bunu, Idris Bello, Daniel Kolo, Are Bolaji, Nasir Kwara, Maj. Gen. Suleiman Said (rtd) and Abiodun Akinlade.

Buhari also appointed Olufemi Omosanya, Adeoye Olalekan, Adeniyi Olowofela, Stephen Jings, Wokocha Augustine, Abdullahi Tafida, Armaya’u Abubakar, Jibril Maigari, Sani Garba and Adamu Sidi-Ali.

The appointment was contained in a letter, which was read out by Lawan, at plenary on Tuesday.

Joe Biden launches VP search committee for White House bid

Joe Biden, the presumptive Democratic presidential nominee, on Thursday, unveiled a committee to help him search for and vet a running mate in his White House race against Donald Trump.
The step comes as Biden faces mounting pressure to address allegations by a former aide that he sexually assaulted her in the 1990s, and as top Democrats came to the party icon’s defense.
Biden has pledged to pick a woman for vice president, a position he himself held for eight years during Barack Obama’s presidency.
“Selecting a vice presidential candidate is one of the most important decisions in a presidential campaign and no one knows this more than Joe Biden,” his campaign manager Jen O’Malley Dillon said in a statement.
The co-chairs are former senator Chris Dodd; congresswoman Lisa Blunt Rochester; Los Angeles Mayor Eric Garcetti; and Cynthia Hogan, a former counsel to Biden.
“These four co-chairs reflect the strength and diversity of our party, and will provide tremendous insight and expertise to what will be a rigorous selection and vetting process,” O’Malley Dillon said.
The committee’s formation comes amid increasing pressure for Biden to address allegations that in 1993 he assaulted a 29-year-old staff assistant who worked in his US Senate office.
Biden’s campaign has denied the claims, but he himself has not responded directly to the allegations by Tara Reade, now 56.
US House Speaker Nancy Pelosi, who this week endorsed Biden for president, addressed the issue at her Thursday press conference which focused on the coronavirus pandemic.

– Pelosi defends –
“I have complete respect for the Me Too movement” against sexual harassment, Pelosi said.

But she stressed that “there was never any record” about the assault, and “nobody ever came forward to say something about it apart from the principal involved” until 27 years later.
Biden is “a person of great values” who has fought for women’s rights throughout his political career, she said.
“I have great comfort level with the situation as I see it, with all due respect in the world for any woman who comes forward, with all the highest regard for Joe Biden.”
Several women seen as candidates to be Biden’s running mate, including Senator Kamala Harris and former Georgia state lawmaker Stacey Abrams, have expressed support for Biden regarding the allegations.
“I know Joe Biden and I think he’s telling the truth and this did not happen,” Abrams, who narrowly lost the Georgia governor’s race in 2018, told CNN Tuesday.
Biden, 77, said Wednesday he had a proud history of campaigning against sexual violence.
“As you know, I wrote and championed the Violence Against Women Act, transformed how this country gets justice and support to survivors and led the ‘It’s On Us’ campaign to fight sexual assault on campuses,” he told a virtual town hall.
The Reade allegations present a thorny problem for his campaign.
Harris and Senator Amy Klobuchar, another potential running mate, played leading roles in opposing the confirmation of Brett Kavanaugh to the Supreme Court over unproven accusations that he sexually assaulted a woman at a high school party in the 1980s.

Libya's unity government says rejects Haftar's truce offer

This image grab taken from a video published by the War Information Division of military strongman Khalifa Haftar’s self-proclaimed Libyan National Army (LNA) on April 28, 2020 shows Haftar giving a speech, saying he had “a popular mandate” to govern the country, declaring a key 2015 political deal over and vowing to press his assault to seize Tripoli. – In a speech on his Libya al-Hadath TV channel, Haftar said his self-styled Libyan “army” was “proud to be mandated with the historic task” of leading Libya. He did not make clear whether an elected parliament in the country’s east, a signatory to the deal, backed his move — or what its future role would be. Haftar has so far drawn his legitimacy from the administration based in the country’s east, and last April his forces launched an assault to seize the capital Tripoli, in the west, from the Government of National Accord. (Photo by – / LNA War Information Division / AFP) /

Libya’s UN-recognised government Thursday rejected a truce unilaterally called the day before by military strongman Khalifa Haftar, saying it “did not trust” the announcement made by its eastern-based rival.

The Tripoli-based Government of National Accord (GNA) said in a statement that it will continue in its “legitimate defence”, attacking “any threat where it exists and putting an end to outlaw groups”.

It was referring to forces loyal to Haftar, who launched an offensive on the capital in April last year.

Haftar said Wednesday his forces would cease hostilities for the Muslim holy month of Ramadan, which began on April 24, following international calls for a truce in the war-torn country.

“The commander-general announces the halting of military operations from his side,” said Ahmad al-Mesmari, a spokesman for Haftar — who controls the east and swathes of southern Libya — from the city of Benghazi.

However, the fighting did not stop in Tripoli after Mesmari’s announcement, with explosions still heard from the centre of the capital, according to an AFP correspondent.

Since fighting began in April 2019, several ceasefires between Haftar’s forces and the GNA have fallen through, with both sides accusing the other of violations.

“These violations make it so we do not trust truce announcements (from Haftar),” the GNA said in its statement.

Any “ceasefire needs to have international safeguards and mechanisms” to monitor its implementation and to document violations, the GNA added.

Last week, the UN, EU and several countries called for both sides to lay down their arms during the holy month.

Haftar’s announcement came after his forces suffered a series of setbacks in recent weeks, with GNA forces ousting them from two key coastal cities west of Tripoli.

The North African nation has been gripped by chaos since the 2011 ouster and killing of longtime dictator Moamer Kadhafi, with rival administrations in the east and west vying for power.

President Buhari Reveals Why He Trekked 800 Metres In Daura

President Muhammadu Buhari on  Friday said his decision to trek some distance after observing Eid prayers at Kofar Arewa Eid Ground to his residence in Daura, Katsina State was not about proving his fitness level, Punch Metro reports.

According to a statement by his Senior Special Assistant on Media and Publicity, Garba Shehu, the President spoke while receiving representatives of the five local governments in Daura Emirate at his private residence.

Garba had told journalists shortly after Buhari embarked on the trek on Tuesday that it was a confirmation that the President was fit for second term.

But Buhari explained that the walk was not about proving his fitness level or scoring cheap political capital.

He said he did not need to convince anybody about his state of health.

He said, ‘‘This is my constituency, the people came out in their large numbers to see me and the car in which I was being driven had tinted windows.

‘‘They were not seeing me so I came down so they could see me.  I didn’t need to convince anyone about my health and the decision to contest for a second term that I made public in April this year.”

The President seized the opportunity of his meeting with his kinsmen to inform them that he has directed the Ministry of Agriculture and the Central Bank of Nigeria to review the processes on the issuance of loans to smallholder farmers.

‘‘We want to make it easier for them to assess the loans, particularly the underprivileged people in the society.  It has become necessary for the government to do this because banks will insist on collaterals which majority of farmers do not have.

‘‘For our agriculture policy to succeed, we must be able to reach small farm holders with loans without collaterals.  Collaterals are always a problem with smallholder farmers,’’ he said.

The President also highlighted the achievements of the administration on local rice productions which he said had led to the reduction of imports by over 90 per cent.

He expressed delight that young people were returning to the farms and reaffirmed the Federal Government’s commitment to implementing policies to promote agriculture.

Speaking on behalf for the civil society groups in Daura Emirate, the spokesman of the group, Yusuf  Maiadua, applauded the President on his numerous achievements.

‘‘You have made us proud, the economy is back on the path of growth and you have laid a solid foundation for the development of the country,” he said.

Gov. Okorocha

While speaking during a breakfast meeting with journalists at the Government House Owerri, the Imo State Governor, Rochas Okorocha, on Thursday, said that he is more favoured to become the next President of Igbo extraction.

According to The Nation, Okorocha noted that he commands massive followership beyond the Southeast much more than any other Igbo politician.

Speaking further, he said that he will not be relying on the support of the Igbo to pursue and actualize his Presidential ambition.

According to him, “I stand a better chance of making the Presidency in 2023 but my greatest challenge will come from the Igbo. It is our character. It will be a foolish thing to imagine that the Igbo will support me”.

Osun governorship: Babatope begs PDP members to unite for victory

A Chieftain of the Peoples Democratic Party (PDP), Chief Ebenezer Babatope,  on Friday urged all members of the party in Osun to put aside all differences and rally round Sen. Ademola Adeleke to win the Sept. 22 governorship election.Babatope, a former Minister of Transportation, made the appeal in an interview with newsmen in Lagos.

He urged party members to see Wednesday ‘s ruling of an Osogbo High Court which failed to stop Adeleke’s candidacy as a victory, not for Adeleke alone, but for the party.

The plaintiffs, Rasheed Olabayo and Idowu Oluwaseun, had sought the order of the court to disqualify Adeleke based on his educational qualification.

Recall that disagreements had trailed the July 21 PDP governorship primary, with seven aspirants, including Mr Akin Ogunbiyi, faulting the process that produced Adeleke and vowing to challenge his emergence in court.

Babatope, who is from Osun, appealed particularly to aspirants who contested along with Adeleke to put loyalty to the party above any grievances they might have and support Adeleke to win the election.

“This is not the time to fan the embers of discord or disunity in Osun PDP.

“This is the time to see ourselves as brothers and unite to support our candidate to win the Sept. 22 poll.

“We should put loyalty to the party first above everything. Though differences are normal in politics, we should learn how to rise above our disagreements.

“We should put the grievances of the primary behind us and speak in one voice with the common objective of winning the election,” he said.

Babatope said the South West PDP, led by Dr. Eddy Olafeso, and elders like Chief Olabode George and himself would continue to reach out to members in the state on the need to unite to defeat the All Progressives Congress (APC).

He expressed the optimism that the PDP would win the Sept. 22 election.

Kwarans will soon cease being panhandlers – Lai Mohammed

The Minister of Information and Culture, Alhaji Lai Mohammed, has called for unity, sacrifice and commitment from all stakeholders in order to put Kwara state on the path of good governance and also win the state for President Muhammadu Buhari in the 2019 elections.

The Minister, who made the call at a stakeholders’ meeting organized by the Congress of Kwara Progressives in Ilorin on Thursday, said the time is ripe for the people of Kwara to take back their state from plunderers.

Lai Mohammed

Lai Mohammed

”What an auspicious time for all of us! Never before have we had a great opportunity like we have now to take our state back from the rapacious few, who have held the state by the jugular and prevented it from meeting the hopes and aspirations of its people.

”From my consultations with key stakeholders so far, I can say, categorically, that Kwarans have all resolved to take their destiny into their own hands and take back what rightly belongs to them. This is unprecedented in the history of our state, and we must not waste this opportunity,” he charged

Alhaji Mohammed stressed the need for unity on the part of the people, saying ”if we all remain united, we can’t and we won’t lose the looming battle for the survival of our dear state. All that is required is for us all to subordinate our individual ambitions to the collective efforts to wrest our state from the hegemony of one man and his cohorts”.

He said that, on his part, he won’t be running for any office during the forthcoming elections, adding: ”For me, it is not about any clamour for office. It is about working with all like minds for the greater benefit of our people.”

The Minister warned that the battle ahead would not be easy, and that those who are opposed to change in the state will deploy all strategies, including blackmail, to retain their stranglehold on power

”Make no mistake about it, the battle ahead will be tough. No one with power will ever give it up easily. But the power of the people supersedes all powers. That’s why I am delighted, and indeed encouraged, that the good people of our state, whether from the North, South or Central, are all united in their singular determination to rescue their state from the grinding poverty, monumental misgovernance and the general state of funk that has enveloped it,” he said.

Alhaji Mohammed said it is a mere blackmail to say he does not like the people of Ilorin, and went ahead to enumerate his antecedents, which include actively supporting an Ilorin indigene for governor in 2011.

He assured that under the new dispensation in the state, every Kwaran counts and will have a voice, saying: ”The resources of Kwara will be used for the development of the state and its people. Never again will our people be turned to panhandlers, never again will our people be made to eat crumbs from the master’s table. We must become the masters of our own destiny.”

Mega reception for Akpabio holds Aug. 8 – APC

Sen. Ita Enang, Senior Special Assistant (SSA) to the President on National Assembly Matters (Senate), has confirmed the defection of Sen. Godswill Akpabio to the All Progressives Congress(APC).

Enang and Sen. Ahmed Lawan, Senate Majority Leader, spoke with State House correspondents shortly after a closed door meeting with Acting President, Prof. Yemi Osinbajo on Monday in Abuja.

Enang said that Akpabio would be formally received in the party on Aug.8 in Akwa Ibom.

Prior to his defection, Akpabio was the Senate Minority Leader and a chieftain of the Peoples Democratic Party (PDP).

“Lawan has said that there are 53 Senators in APC but I want to assure him that APC has harvested people from PDP and other political parties.

“ Akpabio is formally joining the APC and that will be a big ceremony on Aug. 8 in Akwa Ibom.’’

The Presidential Liaison in the Senate warned that the country might face total government shut down, if the National Assembly does not reconvene urgently.

“We are still appealing to the National Assembly to reconvene; you remember that we passed the budget with the understanding that a great amount of the money will be gotten from foreign loans.

“Although it was approved that there would be a loan, the amount that would be gotten was not approved; the Fiscal Responsibility Act requires that the President should specifically state the amount he wants to get from foreign loans and present it before the National Assembly.

“That letter has been presented before the National Assembly and it has to pass that amount before it could be obtained from the foreign financing institutions.

“This is what we are asking and if does not happen, in the next few months, we have a complete government shut down because what we are receiving from the Federation Account as Federal Government share — the capital component — is not enough to sustain even 15 per cent to 20 percent of budget.

“So, there may be a complete government shut down and I know Nigerians will not like it; that is why we are appealing to the National Assembly to reconvene,’’ he said.

Herdsmen killings: Opposition creating fight between Christians, Muslims – Lai Mohammed

The Federal Government on Monday revealed how the opposition was allegedly pitching Christians against Muslims under the President Muhammadu Buhari-led administration.

Minister of Information and Culture, Lai Mohammed said the opposition was creating problems between Christians and Muslims through the spread of fake news.

In a statement he issued in Abuja, the Minister said the opposition through such method has decided to blame killings in certain parts of the country on herdsmen.

Mohammed, however, noted that the Buhari-led government will not relent until it provides security for the citizens.

The Minister said in Benue and Zamfara States respectively, the government has put measures in place to stop the killings but that the opposition has “either downplayed or ignored this”.

According to Mohammed, “With the Buhari administration delivering on its promises to fight corruption, build the nation’s economy and tackle insecurity, the opposition has realised it will not make any impact if it takes on the administration on that turf.

“So, it has decided to take the easy route, which is to use fake news and hate speech to de-market the administration, pitch Christians against Muslim and one ethnic group against another. In short, they want to plunge the country into turmoil.

“It is said that the easy way is not always the right way. The opposition knows that, but it doesn’t care. It is hellbent on dividing Nigerians along ethnic and religious lines. It is using fake news to blame all the killings in a certain part of the country on herdsmen, ignoring the bands of deadly militia groups that are being sponsored by unscrupulous people to kill innocent people and put the nation on edge.

“It is distorting the fact that the clashes between the farmers and herders are being aggravated by climate change – which has heightened the contest for scarce natural resources like water and land – as well as demographic pressure. With a population of 45 million in 1960, Nigeria is today approaching the 200-million mark. Yet the resources have not expanded, and have in fact been shrinking. It is ignoring the role of sheer criminality in the crisis.

“We condemn the killings of innocent people for whatever reasons. And that is why the administration has put all necessary measures in place to stem the killings. In Zamfara, for example, you can see how the military has put the bandits on the run. In Benue, the police and the military are working hard, and that has resulted in a drastic fall in the spate of killings. Sadly, the media has either downplayed or ignored this.

“This government will not relent until every Nigerian can sleep with his or her two eyes closed.”

Why Dasuki May Not Be Released Even After Court Order - Presidency

Sambo Dasuki

A Senior Special Assistant to the President on Judiciary Reforms, Juliet Ibekaku-Nwagwu, has revealed why a former National Security Adviser, Col. Sambo Dasuki, may not be released despite the bail granted him.

According to her, Nigeria must spare nothing in the fight against corruption.

She said that those calling for the release of Dasuki should consider the fact that many innocent Nigerians died just because the former NSA shared the money meant to fight insurgency to politicians.

Ibekaku-Nwagwu spoke with the Sun newspaper, saying, “I wish you could tell me a couple of judgments that the government disobeyed apart from the Dansuki’s case, which is really based on national security interest.

“I want to know about other cases. If you have to balance national security, the interest of persons and individuals, there has never been any country where you allow an individual’s interest to override the national security. And until we can come to grasp with the facts that an individual sat back and allowed several human beings to be killed and slaughtered in the North-east without using the money meant for buying arms for the military.

“Until we come to grasp with the fact that the fundamental problems we have today, part of the security problems we have today, is traceable to the corruption that started way back before this government came into office.

“And if we are trying to balance that national security interest with that of individual interest, I am sure the courts will review their decision.

“The security problems we have today in Benue, Plateau, Taraba, Adamawa and other states are not something that are just happening, it goes beyond that. Somebody is funding it; somebody is equipping, somebody is making sure that those people can go out and create so much mayhem and kill several human beings.

“We need to come to terms that we have a national security problem in this country. And how we deal

with it sometimes is to allow a presidential directive to enable us to deal with these problems. What I am saying is that when we talk about the case as it is, we should always make sure that we do an analysis of the historical antecedents that led us to

where we are today.

“The matter is still in court and the government of Nigeria reserves the right to go to appeal on that decision. So, the government of Nigeria is reviewing the judicial decision; the government of Nigeria will determine whether to go on appeal and request for ‘stay of execution’ on this matter. It is not a political matter.

“It is a security matter. I think between the judiciary and the executive, there is an on-going discussion as to whether this particular decision requires a further judicial review by way of an appeal. Let us allow the appeal process to be exhausted.”

Why Yoruba may soon become irrelevant in Nigeria – Bode George

The former Deputy National Chairman of the Peoples Democratic Party, Chief Bode George, has warned that the Yoruba may become irrelevant in Nigeria.

He said this is because its people are too much hindered by parochial pursuits to the detriment of the greater vision of the tribe.

He called on the Yoruba people to return to the good old days when hard work and perseverance were treasured over the lazy recourse to the easy ways.

He called on Yoruba sons and daughters to unite and shun selfish interests in order to remain a formidable and relevant part of Nigeria.

George said this in Osogbo on Tuesday at the Grand Zonal Congress of the South-West Youth and Women Leaders.

According to him, Yoruba leaders could no longer choose to go in different directions due to distrust and selfishness and still expect the race to tower above others.

George said, “The Yoruba founding pioneers were indeed representative of men and women who came from the furthest reaches of Ekiti, the fertile expanses of Ondo land, the streams and waters of Osun, the forests and thickets of Oyo and the mountainous ranges of the Atlantic shores.

“Today, we occupy an inevitable position in the Nigerian firmament because we are now too much self-absorbed. We are too much hindered by parochial pursuits to the detriment of the greater Yoruba vision. We have dismantled the collective oneness which once gave us the cutting edge advantage in the past.

“We must return to the sacred dignities of old where personal ambitions were restrained by humility. We must return to the instinctive patriotic zeal that insists on sacrifice and selfless service. We must return to the good old days when hard work and perseverance were treasured over the lazy recourse to the easy ways.

“We can no longer afford to be going in different directions. That will not get us anywhere. It will always result in confusion and chaos. It will always result in aimlessness and forfeiture. As we push and pull in different ways, we become weaker and invariably enfeebled without any relevance, without any cogent achievements.”

Zimbabwe’s Ruling Party ZANU-PF Wins Most Seats In Parliament

Election officials tally presidential candidates ballots during counting operations for Zimbabwe’s general election at the David Livingston Primary school in central Harare on July 30, 2018.

MARCO LONGARI / AFP

Zimbabwe’s ruling ZANU-PF party won the most seats in parliament, official results showed Wednesday, as the count continued in the presidential race and the opposition MDC cried foul, alleging widespread fraud.

EU observers are due to give their preliminary report on Zimbabwe’s election later Wednesday, two days after the vote — the first ballot since Robert Mugabe was ousted after 37 years in power.

With elections under Mugabe marred by fraud and often deadly violence, his successor President Emmerson Mnangagwa, 75, promised a free and fair vote and invited international observers.

“The Zimbabwe Electoral Commission (ZEC) has announced a further 50 National Assembly results, bringing the total so far to 153. Of the 153, ZANU-PF has won 110 seats, while the MDC Alliance got 41 seats,” ZBC state media reported.

There are 210 seats in the national assembly lower house.

MDC did not immediately respond to the parliamentary results but earlier on Wednesday party leader and presidential contender Nelson Chamisa, 40, said the presidential results were being faked.

“ZEC seeks to… reverse the people’s presidential election victory. The strategy is meant to prepare Zim mentally to accept fake presidential results,” he tweeted.

“We won the popular vote and will defend it!”

If no presidential candidate wins at least 50 percent of the ballots cast in the first round, a run-off vote is scheduled for September 8.

On Wednesday, observers from the Southern African Development Community and the African Union will also deliver reports on the polls.

Government warning

Opposition Movement for Democratic Change (MDC) supporters started celebrating Tuesday after a senior party official said that the party was sure Chamisa had won and that if he was not declared victorious, it would “announce our own results”.

That apparently prompted Home Affairs Minister Obert Mpofu to warn that anyone illegally announcing results would “provoke the wrath of the law and risk being sent to jail”.

The electoral commission has warned that results of the presidential first round may not be known until Friday or even Saturday and would not be released until tallies were received from all 10,985 polling stations.

“We are nowhere near where we expected to be, so I can quite see us going into the fifth day which is allowed by law — but we are working flat-out,” commission chairwoman Priscilla Chigumba told journalists in the capital.

Chigumba, a high court judge, has flatly denied allegations of bias and strongly disputed accusations of rigging.

Analysts have said it was unclear whether the country’s generals, who ousted Mugabe and ushered Mnangagwa into office, would allow an MDC victory.

“There is no way that ZANU-PF will accept an MDC victory. We know that people will be beaten — especially in rural areas, like what they were doing before,” said Harare shop worker Tracy Kubara, 26.

Mugabe, 94, who ruled for nearly four decades, voted in Harare alongside his wife Grace.

It followed a surprise press conference at which he stunned observers and called for voters to reject ZANU-PF, his former party.

Mnangagwa, Mugabe’s former right-hand man, was the clear election front-runner, benefitting from tacit military support and control of state resources.

But Chamisa, a lawyer and pastor who performed strongly on the campaign trail, sought to tap into the youth and urban vote.

He has repeatedly accused ZANU-PF and election authorities of trying to use a flawed electoral register and fixed ballot papers to steal the election.

Whoever wins will face a mass unemployment crisis and an economy shattered by the Mugabe-era seizure of white-owned farms, the collapse of agriculture, hyperinflation and an exodus of investment.

APC dep guber candidate: Osun West has it!

The All Progressives Congress, APC, in Osun State has filed in a dummy as running mate to the party’s candidate, Gboyega Oyetola as the party yesterday assured that the office remained zoned to Osun West Senatorial District.

Alhaji Gboyega Oyetola

Alhaji Gboyega Oyetola

The party has also asked its members and supporters not to panic over the issue of who will emerge as the deputy governor as it yesterday said that the issue is not yet finalised.

A statement by the party’s Directorate of Publicity, Research and Strategy, Kunle Oyatomi, said ‘’the decision to pick a candidate for that position from Osun West has not changed and will not change.’’ The party explained that the name originally forwarded to the Independent National Electoral Commission for the deputy, was a provisional one to complete the governorship flag bearer’s name submission which was mandatory.

As at the time that submission was made, a final decision on who will be the deputy from Osun West had not been taken.

‘’By provision of the law, we still have a three-week window to replace whatever name had been originally submitted with our flag bearer’s.

‘’That gives the party a breathing space to arrive at a   consensus on who should represent Osun West as the deputy governor’’, the party explained. “There is no cause for panic’’ the APC assured, adding that, ‘’party members should disregard the rumours making the rounds that the West has been betrayed.

“Rest assured that the deputy governorship candidate that will be on the APC ticket for the September election will irrevocably be from Osun West”

NASS and the retrogressive Media Bill

DEMOCRACY requires an active media to thrive. This is because the parameters that constitute good governance, which is a common feature of a vibrant civil rule, can be measured by the level of accountability, transparency and rule of law that exist in a country. Ordinarily, it is a difficult task for many governments to appraise itself for good or bad. Hence, the importance of the media in serving as the prism to review the performance of democratic governance. An attempt to stifle the media in carrying out these functions would bring about dire consequences for good governance.

Senate

A case under contention is the Nigerian Press Council Amendment Bill, which has already been debated at the public hearing stage. The bill seeks to regulate journalism practice by creating a statutory body to arbitrate between the media and the public. It is on this premise that the media can be compromised, that Nigerians are angered with the new media bill before the National Assembly and have  described it  as retrogressive, unconstitutional and anti-people.

The main justification that promoters of the legislation are hinged on is that today, proliferation of the media is so severe that fake news and hate speech have dominated public spheres and pose national security problems. We daily read false stories, recycled information and outright falsehood, mostly in the social media which could trigger violence, enmity and hatred among the people. Ordinarily, any responsible government should be bothered about the flow of information, fostered under an atmosphere of peace, sanity and tranquility. This is more important now that the general elections are fast approaching. The media should, therefore, not be a weapon for creating chaos, disaffection and intimidation in the land. Logical, is this line of argument.

Beyond this thought, the introduction of the anti-media bill at this time is not only curious but apprehensive. It is suggestive of a deliberate plan to manipulate the media towards certain political advantage. It is also instructive to say that the action is sub judice since a suit on the subject-matter is still pending before the Supreme Court, which questions the rationale behind why the bill should have been drafted in the first instance. The lawmakers should have awaited the outcome of the court’s ruling without acting in contempt of the court.

It is because of this constitutional crisis that many people feel that the introduction of the bill is nothing, but a mere amalgamation of the obnoxious Public Officers Protection Against False Accusation Decree No. 4 of 1984 and Newspapers Registration Decree 43 of 1993, being brought back into our legal system through the back-door; the draconian laws that were promulgated during the totalitarian military rule in the country. It’s existence would criminalise journalism practice in Nigeria. Do we need this?

The answer is ‘no’. Already, there are several extant laws in the country that can tame the excesses of media practitioners. The birth of the imposed bill would make the Nigeria Press Council, NPC; a Federal Government agency, to usurp the powers of the courts by assuming extra-judicial powers in the course of carrying out its statutory duties. In addition, the bill is inconsistent with the provisions of Sections 22, 39 of the 1999 Nigerian Constitution (as amended) and Article 9 of the African Charter on Human and Peoples’ Rights (Ratification and Enforcement Act) No. 2 of 1983 to which Nigeria is a signatory and is also part of the country’s laws.

That the bill, through some of its other obnoxious provisions, intends to indoctrinate Nigerians, through the use and misuse of educational curricula in the training of journalists and usurp the powers of the regulatory bodies in the educational sector that are equipped and designed to teach courses in media and journalism such as the National Universities Commission, NUC, and the National Board for Technical Education, NBTE, that regulate the teaching and research in the fields of journalism, mass communication and similar courses in the universities, polytechnics, monotechnics and colleges of technology. This is unnecessary and a misplaced priority.

Nigeria should do this rightly. We should not take after countries that are not getting it right  in democratic practice and  press freedom. The United States of America, Great Britain, France and Canada can be said to be doing well in terms of free press. But many African and developing countries  still lag behind in creating room for media independence. Recently, the Egyptian parliament approved during a final reading, similar obnoxious bill that would allow government authorities to monitor social media users in the name of combatting ‘fake news’. Under the new law, people whose social media accounts have more than 5,000 followers are to be placed under the supervision of Egypt’s Supreme Council for Media Regulations.

The  bill, which had been backed by two thirds of the Egyptian parliament, would require the assent of President Abdel Fattah el-Sisi, before being ratified into law. This unwarranted censorship would encompass websites, blogs and personal accounts in Egypt. The council (similar to the NPC), would be authorised to suspend or block any personal account that publishes or  broadcasts fake news, or anything inciting that violates the law, or creates violence or hatred.

Article 29 of the bill states that journalists should be jailed pending trial, if found guilty of inciting violence or hatred or discrimination through their writings. Imprisonment before trial! Many journalists are currently behind bars in Egypt. Social media platforms such as Twitter and Facebook have become one of the last forums for public debate in Egypt since the 2013 ban on all gatherings without police approval. Over 500 websites have allegedly been either blocked or closed down while those who administer the websites have faced jail time or made to pay heavy fines.

We recall that Nigerians are more active in protecting the nation’s democracy at all cost. A similar and controversial bill failed to sail through the parliament in 2016, when the Frivolous Petitions Prohibition Bill (also known as the Social Media Bill) was being pushed for passage into law before it ‘died’ at the Senate plenary.

The bill was dropped during the celebration of the International Technology Day, an event that offered an opportunity  for users of the Internet and service providers to examine the impact of the social media on good governance. This is likely to be the same path the new legislation is bound to take going by criticisms that had trailed its incursion into our political lexicon.

2019: Gov. Okorocha speaks on Saraki’s exit from APC affecting Buhari’s re-election

The Governor of Imo State, Rochas Okorocha has insisted that the defection of the Senate President, Bukola Saraki from the All Progressives Congress (APC), will not affect President Muhammadu Buhari’s re-election next year.

Okorocha spoke on the sidelines of the swearing in of the new chairman of the All Progressives Congress, APC, in Imo state, Daniel Madueke Nwafor, at the party’s national secretariat in Abuja.

He said: “They didn’t tell me when they joined the party and I don’t want to know when they are leaving. So, people are entitled to their opinion on how they see issues.

“Political party is just like a vehicle with which you get to the appointed destination and if they found that they can no longer get what they want in APC and they want to get to other parties, good luck!

“But the question you should ask me is that, how does that affect the party in 2019. I don’t see in anyway how it has affected the party negatively and the issue there is that President Muhammadu Buhari will win his reelection come 2019. “He is stronger and firm; he will do better than how he had done before in terms of electoral values.

“So, his (Saraki’s) defection is allowed. As they are going, many people are still coming into the party in their thousands.

“It is neither here nor there. We shouldn’t make a big issue of it. Saraki is entitled to his political opinion and he wants to leave, good luck and the governor of Kwara, my colleague leaves, good luck.”

Imo: Madumere reacts to his impeachment as Deputy Governor, blames Okorocha

Impeached Deputy Governor of Imo state, Eze Madumere, has accused Governor Rochas Okorocha, of being behind his impeachment.

Madumere was on Monday impeached by the state House of Assembly over alleged gross misconduct.

But the action was in defiance to the ruling of a state High Court presided over by Justice Ben Iheka on July 30, restraining the legislators and the Chief Judge of the state, Justice Paschal Nnadi, from any further moves regarding the impeachment process.

Reacting, the impeached Deputy Governor in a statement by his media aide, Uche Onwuchekwa described his removal from office as illegal, saying neither the state House of Assembly nor the seven-man panel set up by the Chief Judge of the state, Paschal Nnadi, invited him to any of their sittings.

Madumere stated that the State House of Assembly was being used as a willing tool in the hands of the governor for political witch hunting.

The statement reads in part: “The state house of Assembly has become a mere stooge in the hands of the governor.

“In disobedience to the restraining order against the the Chief Judge, the seven-man panel, Speaker and members of Imo State House of Assembly from further action on the controversial impeachment proceeding against the Deputy Governor of Imo State, Prince Eze Madumere, the House of Assembly in Gestapo manner, has removed the Deputy Governor of the state from office.

“The Presiding Judge of High Court 8, Justice Benjamin Iheka had restrained the seven-man panel of Inquiry constituted by the Chief Judge, Hon. Justice Paschal Nnadi, the Chief Judge, Speaker and members of Imo State House of Assembly over a matter brought before the court that bothers on constitutional breaches in the procedure adopted to remove the Deputy Governor from the office.

“The Acho Ihim-led faction of the members of the House sponsored by Governor Okorocha against the Court Order and the rule of law illegally removed the Deputy Governor in a kangaroo manner.

“Against the requirement of the law, Prince Madumere was not given fair hearing as he was neither invited during the sitting of the investigative committee in the House of Assembly nor by the seven-man panel set up the Chief Judge.”

BREAKING: APC spokesman, Abdullahi joins Saraki, Ahmed, dumps APC for PDP

Bolaji Abdullahi, National Publicity Secretary, of the All Progressives Congress (APC) has dumped the party.

Information which circulated Tuesday morning had suggested that the former Minister of Youth Development was planning to return to the Peoples’s Democratic Party (PDP).

Our correspondent sent him text to confirm or refute the news but the official said he couldn’t talk at that moment.

Abdullahi defected later in the day with Senate President Bukola Saraki and Kwara State Governor, Alhaji Abdulfatah Ahmed.

A closed aide to Saraki confirmed to DAILY POST that the APC spokesman too has jumped ship.

The development was expected; Abdullahi is a member of Saraki’s dynasty.

He is expected to run for a political position in 2019 on the platform of the PDP.

Ahmed had explained that his decision followed due consultations with the people and in response to calls by major stakeholder groups in the state.

He added that he defected to PDP, having realized that the APC “can no longer serve as a platform for achieving the aspirations and expectations of his people”.

His announcement coincided with that of Senate President, Bukola Saraki.

Saraki wrote on his Twitter page: “I wish to inform Nigerians that, after extensive consultations, I have decided to take my leave off the All Progressives Congress (APC).”
